TERMS AND CONDITIONS 
 
Your travel booking is made with TRAVEL4PURPOSE IMPACT ADVENTURES LIMITED (“T4P”).
 
 
  1. GETTING STARTED
1.1. At T4P, we do not offer “cookie-cutter” packages. Our experienced and diligent team aims to create bespoke travel experiences that match your every need and further your internal drive. To do this, we need to gain an understanding from you about what your purpose is and what has led you to want to be part of our tribe. To do this, we may need to reach out to you by telephone, email or any other form of communication as T4P deems fit. 
 
1.2. Your safety is one of our main priorities, but to serve you the best where we can, you are responsible for informing us of any extenuating medical conditions, dietary requirements or other such circumstances which will need to be taken into account when curating your trip. We promise to work with you at every stage to accommodate your health and safety needs as far as possible; however there is no guarantee that all your requests can be met. We can assure you that anything you tell us will be held in confidence.
 
1.3. Depending on the duration, type and intricacies of your unique travel experience, we guarantee that a first draft itinerary will be sent to you digitally. We see the curation of your trip as a two-way street and whilst we will impart all our knowledge and carry out all the groundwork, we want to make sure you are happy at every juncture. 
 
 
  1. PAYMENTS
2.1 Once your itinerary is finalised and you are happy with it, we will provide you with a bookings invoice for the full amount at the agreed price. Until your invoice has been paid in full, all aspects of the itinerary are subject to availability and / or price change.
 
2.2. If you pay the initial $80 personalised itinerary package fee, you are entitled to $100 off if you spend a minimum of $500 on T4P specific activities. The $100 can not be redeemed for accommodation or transport bookings, only T4P curated activities. 
 
2.3. The terms and conditions relating to your payment are set out in this document only, including details of agreement and acceptance.
 
2.4. Your invoice will clearly state the date by which you are due to make payment of your invoice in full. The time frame for payment is based on each individual and depends on the amount you are being invoiced for. If you fail to make payment of your invoice in full within seven calendar days after the date of payment stated on your invoice, T4P reserves the right to cancel your trip without notice and you will be liable for any additional costs incurred. 
 
 
  1. PRICES
3.1. The amount you will be invoiced for will be inclusive of T4P’s services and any outsourced activities that T4P will negotiate on your behalf. T4P will not be providing a breakdown of costs. However, should you not be satisfied with the final trip price (the “Travel Fee”), we may be able to adjust your bespoke itinerary to meet your budgetary requirements.
 
3.2 All prices quoted by T4P will be in Kenyan Shillings or US Dollars, unless otherwise stated.
 
3.3 We reserve the right to impose surcharges in respect of cost increases incurred during the curation of your personalised trip. By way of example, this may include, but is not limited to, cost increases due to currency fluctuations, cost increases imposed by suppliers, government action, changes to the trip by yourself e.t.c. T4P may choose to take up the cost increases or seek your consent in case of a price change or take any other action  as T4P deems fit. 
 
3.4. Please note that unless otherwise stated, the Travel Fee typically does not include cost of airfare, visas, additional baggage fees; personal expenses; optional sightseeing; gratuities fees(which are at your discretion); and travel protection insurance. These are all expenses which are to be paid for and arranged by you, however if you request we can inform you of all the additional costs we anticipate you will have to pay for and arrange for yourself as a complimentary service. We can also make recommendations for the same, should you request this.
 
 
  1. CHANGES OR CANCELLATION BY YOU
4.1. Whilst we hope that, after the itinerary is agreed and payment is made,  you will be happy and excited for your trip, we understand that there may be changes or adjustments which you would like to make. If you do wish to make any changes after you have paid the Travel Fee in full, we will try our best to accommodate them, however this may not always be possible.
 
4.2. We would be sad to see you go, however, if you do for any reason need to cancel your personalised trip at any time, you will be liable to pay a cancellation fee, as per the below table. The effective date of cancellation will be upon T4P’s receipt of your written notification.

  1. CHANGES OR CANCELLATION BY T4P OR T4P’s SUPPLIERS
5.1. Some aspects of your bespoke trip may be operated by third party suppliers ( the “Suppliers”) These may include, but are not limited to, accommodation, land/sea/air transportation, activities, food and beverage services e.t.c. There may be a situation in which aspects of the service provided by the Suppliers may be altered or canceled in some way, out of T4P’s control. If this is the case, we will ensure that you are promptly notified of any significant changes, although we cannot guarantee that a refund will be available. Please also note that T4P does not accept responsibility for any acts or defaults on the part of any Supplier. 
 
5.2. If T4P is unable to offer a significant portion of the trip, T4P will take whatever action T4P deems fit to maintain the business relationship with you. However, in instances of Force Majeure (as defined below),no refund will be issued. Force majeure means any circumstance not within T4P’s reasonable control including, without limitation:
 
5.2.1 acts of God, flood, drought, earthquake or other natural disaster; 
 
5.2.2 epidemic or pandemic;
 
5.2.3 terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;
 
5.2.4 nuclear, chemical or biological contamination or sonic boom; 
 
5.2.5 any law or any action taken by a government or public authority;
 
5.2.6 collapse of buildings, fire, explosion or accident;
 
5.2.7 Non-Performance by the Suppliers; and
 
5.2.8 interruption or failure of utility service.
 
(“Force Majeure”)
 
  1. INSURANCE
6.1. We do not accept liability for any accidents that may occur during your trip / experience, and costs relating to medical treatment for injuries and/or urgent transportation must be met by you. To be properly protected  in such situations, we strongly recommend that you purchase comprehensive travel insurance that includes sufficient cover, especially regarding cancellation, curtailment, theft, accident, repatriation, medical, third party, liability for injury to others and death, and loss or damage to equipment. Please note that we do not cover the insurance of any accidents or mishaps that may occur during your personalized trip and that this responsibility lies on you. 
 
 
  1. YOUR BEHAVIOUR AND RESPONSIBILITIES
7.1. We promise to do all the leg work in the planning phase, however you are required to stay vigilant and help us to ensure that you stay healthy and fit. This will include (but is not limited to): preparing yourself by reading about the places you are visiting, drinking responsibly and understanding that local living standards, practices, lifestyles, facilities’ may be different (usually in delightful ways) from what you are used to. Where possible, we will point you to some useful reading material. 
 
7.2. At times, we may use any photographic or film records of your bespoke trip for promotional and/or commercial purposes, without any remuneration to you or without having to obtain permission from you. Where possible, you will be asked permission and informed when and who is using the photos or footage.
 
7.3. You are responsible for obtaining and keeping all required travel documentation. This includes any required visas and the possession of a passport that is valid for at least six months from the start date of the trip. You are also responsible for checking in for all flights and other travel arrangements in good time and with the correct documentation. We are not responsible for any costs incurred by you not having the correct documentation when required or failure to be on time for departure.
 
7.4. Our staff will always treat you with the utmost respect. In return,  the same is required of you to our staff and suppliers. You must therefore comply with rules and regulations set by them and we promise to listen to any issues you may have and help when possible. With this in mind, we reserve the right to remove any traveler from all or part of the trip if we feel they are behaving in an unacceptable manner. In such situations, we will not be responsible for repatriation or any costs incurred, and no refund will be given.
 
7.5. You will be liable for any damages inflicted on the properties occupied by you during your trip.
 
7.6. You acknowledge and agree that some of the activities that you will participate in have a risk of accident and injury. Therefore, you will not take any unreasonable risks (for example not drinking responsibly or consuming illegal intoxicants), and if you do, you will be responsible for your own actions. In this regard, you agree to indemnify T4P against any mishap or accident or loss  suffered by yourself or your group  while on your bespoke travel experience. 
 
7.7. You are responsible for the safety of your own property. T4P will not accept any responsibility or liability related to the maintenance, care or safety of your property.. 
 
 
  1. T4P’S RESPONSIBILITIES
8.1. We aim to work towards creating the most positive impact possible with every trip we curate. This not only means a positive impact on the community you are visiting, but also for you as an individual. 
 
8.2. We will respond to your requests promptly and will keep you informed as your itinerary evolves unless T4P is unable to communicate due to the occurrence of a Force Majeure event. 
 
8.3. We will manage our relationships with the Suppliers and endeavor to give you a seamless travel experience. We are responsible for maintaining these relationships and receiving your feedback in relation to the same.
 
8.4. If at any time you have questions or concerns , please let us know as soon as possible. Any complaints or suggestions about your trip should be made to us at hello@travel4purpose.com.
 
 
  1. LIMITATIONS OF LIABILITY
9.1. Please be aware that travel inherently involves risk and while we aim to minimise this risk for you as much as possible, we will not be liable for economic loss and physical or mental injury, directly or indirectly, arising in connection with your trip and the actions of any Suppliers. The trip may take place in a remote location where there is little or no access to modern medical services or hospital facilities for serious and/or particular health issues. You may also be visiting places where the political, cultural, and geographical attributes of the location present risks and physical challenges that are greater than those present in your country of residence. It is your own responsibility to familiarise yourself with all possible relevant travel information in connection with your participation in the trip. Understanding and in full consideration of the foregoing, you agree to solely and exclusively assume full and complete responsibility for and the risks inherent in travel and engaging in activities which may include injury, death, property damage, and/or any other kind of liability, whether foreseen or unforeseen, which may occur during your participation in the trip. You acknowledge that your decision to participate in the trip is made in full consideration of the foregoing information and that you solely and exclusively assume the risks involved with participating in the trip. 
 
9.2. In addition to and without limitation, we are not responsible for any injury, loss, or death, or damage to property in connection with the provision of any goods or services whether resulting from, without limitation, to Force Majeure, illness, disease,labour unrest including strikes, criminal activities of any kind, overbooking or downgrading of services, mechanical or other failure of means of transportation or travel delays, travel advisories or warnings e.t.c.
 
9.3 You acknowledge that you are responsible for all actions and safety of the children and adults who are under your control and will not hold T4P liable for any harm/damage (fatal or otherwise) that may occur during your curated experience/trip. 
 
9.4 You also agree that T4P will not be responsible for any damages or loss suffered as a result of your negligence e.g. (but not limited to) by not drinking responsibly or consuming illegal intoxicants or not wearing a seatbelt while traveling in a motor vehicle e.t.c.  
 
In no event will T4P be liable for any liabilities arising from or in connection with your participation in the trip.
 
 
10. VISAS & PASSPORTS
 
10.1 International travel requires a passport. You must verify all requirements (including all health requirements if any) and obtain a passport and all necessary visas for the trip. If you are refused entry into any country for failing to meet the entry and exit requirements, T4P  will not be liable.
 
 
11. LAW & JURISDICTION
 
11.1. These terms and conditions and all disputes arising out of or in relation to the contract entered into between you and us will be interpreted in accordance with and governed by and under the jurisdiction of the laws of Kenya.
 
11.2. In accepting these Terms and Conditions with us, you accept that any dispute arising from such a contract will be subject to the exclusive jurisdiction of  Kenyan law. 
 
11.3 In the event of a dispute you agree to first attempt to amicably negotiate the dispute with T4P before pursuing any other dispute resolution mechanism.
